<p id='2034_p_11'></p><p id='2034_t_23' class='tclass'>A 1991 amendment to the Higher U.S. Department of Education Act lifted all time limits for collection of student loans. The reporting of defaulted student loans on your credit report can now go on forever. In addition, a 1998 change in federal law made it virtually impossible to discharge a student loan in bankruptcy.</p>
<p id='2034_p_12'></p><p id='2034_t_11' class='tclass'>Collections can report for seven years from the original default date. The original default date is defined as the first time that you missed a scheduled payment. The original default date cannot be reset, and the reporting period cannot be extended by subsequent collectors.</p>
<p id='2034_p_13'></p><p id='2034_t_14' class='tclass'>Once a creditor has passed a charged off account to a collector, the original creditor cannot report the charged off amount as a past due balance. The balance should report as zero; the charged off amount may report on a separate line.</p>
<p id='2034_p_14'></p><p id='2034_t_5' class='tclass'>A Chapter 13 bankruptcy which has been completed will continue to report for seven years from the initial filing date, rather than the discharge date.</p>
<p id='2034_p_15'></p><p id='2034_t_2' class='tclass'>Debts that are discharged in a bankruptcy can continue to report for seven years. It is important to note that once a debt is discharged it should not report with a past due balance, or in a charge off or collection status.</p>
<p id='2034_p_16'></p><p id='2034_t_20' class='tclass'>Paid tax liens may not report more than seven years beyond the date of payment. Unpaid tax liens may report as long as they are in effect. If you are in doubt consult a CPA or tax attorney.</p>
<p id='2034_p_17'></p><p id='2034_t_13' class='tclass'>Collections of charged off accounts have a slightly different reporting period than other collections. Charged off accounts can continue to show on your credit report for seven years plus 180 days from the date of original default, as defined above. This means that this extended reporting period does not start with the charge off date, but rather with the earlier default date.</p>
<p id='2034_p_18'></p><p id='2034_t_10' class='tclass'>Collections are unique for the reason that they typically change hands, often several times during their lifetime. Important credit repair tip! Please note that only one collector at a time can legally report the debt; and only the collector that owns the debt can legally report it. All duplicate collection accounts for the same debt should be deleted from your credit report.</p>

Qualified credit counselors will take a look at your debt and income levels, discuss options for getting out of debt, and discuss the advantages and disadvantages of a debt management program with you.</p>

Do they make monthly payments to creditors or are they on some other schedule?  How does their payment schedule affect your debt?</p>

<p id='1835_p_7'></p><p id='1835_t_9' class='tclass'>If a credit counseling agency only offers debt management programs as their service, you should probably consider using a different credit counseling program that can also provide assistance with budgeting and money management.</p>
<p id='1835_p_8'></p><p id='1835_t_12' class='tclass'>Are there any debts that you currently have that cannot be included in the debt management program?  Find out why, and make sure that you can afford to pay that bill on your own while still paying the proposed debt management monthly payment.</p>

If the debt management payment is higher than what you can afford each month- youÂre not going to make any progress by using the program.  Make sure the monthly payment is reasonable enough that you can make the payment as required each month before the due date.</p>
<p id='1835_p_10'></p><p id='1835_t_2' class='tclass'>If it is determined that a debt management program is the appropriate plan of action for your situation, the credit counselor will develop a payment schedule with each of your unsecured creditors, in an attempt to lower the total amount of money owed, decrease your interest rates, and have over the limit and late fees removed from accounts while you are participating in the credit counseling debt management program.</p>
<p id='1835_p_11'></p><p id='1835_t_6' class='tclass'>Successful debt management programs may take 2 years or more to pay off your debt.  Your credit counselor should be able to estimate how long it will take you to completely pay off each of your existing debt, and chances are you will be required not to apply for or use any other credit while you are part of the program.</p>
<p id='1835_p_12'></p><p id='1835_t_5' class='tclass'>ItÂs always a good idea to get the debt management program terms in writing- and then ask each creditor if they actually do offer the concessions that the credit counselor has indicated.</p>

The agency then takes those deposits and uses them to make payments on your behalf to your student loans, credit cards, medical bills and other unsecured debts- using the payment schedule that the credit counselor has worked out with your creditors.</p>
